Musa Gold Referral Program Terms & Conditions

Welcome to the Musa Gold Referral Program (“Program”). By participating in the Program, you agree to be bound by these Terms and Conditions (“Terms”). Please read these Terms carefully before participating. Musa Gold reserves the right to modify these Terms at any time due to unforeseen circumstances or matters beyond our control, with changes effective upon posting to our website. We will use commercially reasonable efforts to notify you as soon as possible of such changes. Should any dispute arise, the decision of Musa Gold shall be final.

1. Program Overview

The Musa Gold Referral Program allows registered partners (“Partners”) to earn commissions by referring new customers to make purchases that generate a Gold Redemption Receipt (GRR) on the Musa Gold website. Partners receive a unique referral link to track referred traffic and purchases, and commissions are calculated based on eligible transactions.

2. Eligibility and Registration

2.1 Eligibility Criteria:

To participate, you must:
- Be at least 18 years old or the legal age in your jurisdiction.
- Have an active account with Musa Gold with a satisfactory account history, including no history of fraudulent activity, chargebacks, or violations of Musa Gold’s policies.
- Maintain an overall Partner behaviour, as determined by Musa Gold, based on factors such as referral performance, compliance with these Terms, and promotional ethics.
- Have completed at least one successful purchase on the Musa Gold website.
- Comply with all applicable laws and regulations, including data protection and marketing laws.
Musa Gold reserves the right to reject or revoke participation based on its sole discretion if your account history or Partner behaviour does not meet Program standards.

2.2 Registration Process:

You may register as a Partner through the designated registration page, accessible via a direct link or the order confirmation page after a successful purchase.
The registration form may include fields such as Payment Email, Website, promotional methods, and custom fields. You must agree to these Terms by checking the provided checkbox.
Submission of false, misleading, or incomplete information may result in rejection or termination from the Program.

2.3 Verification:

Upon registration, Musa Gold will review your application, including your account history and previous account behaviour. You will receive an email notification and dashboard message confirming your registration.
Approval is contingent upon verification of at least one completed order and a satisfactory account behaviour.
Approved Partners will receive access to a Partner Dashboard containing a unique referral link and performance statistics.

3. Partner Dashboard

The Partner Dashboard provides access to:

Referral traffic statistics (e.g., views).
Commission rates and conditions.
Available coupons (if applicable).
Custom referral nickname (if enabled).
Total referral purchases and revenue.
Payout status and history.

4. Referral Requirements

4.1 Valid Referrals:

New customers must purchase via the unique referral link provided by the Partner to ensure commission eligibility.
Only one referral per new customer will be counted. In the event that a new customer is referred by multiple Partners, the successful referral will be determined based on the Partner details confirmed by the new customer.
Self-referrals are strictly prohibited and will not be eligible for commissions.
The Program is not valid with any other ongoing offers, promotions, vouchers, discounts, or privileges, unless explicitly stated by Musa Gold.

4.2 Partner Warranties:

By participating, the Partner warrants and confirms that:
- The referred potential new customer has given explicit consent for their personal data to be provided to Musa Gold and to receive marketing communications related to the Referral Program.
- The Partner shall indemnify, defend, and hold harmless Musa Gold, its Partners, officers, and employees from any loss, damage, or liability suffered or incurred arising from or in relation to the Partner’s participation in the Program, including breaches of these Terms or applicable laws.
- The Partner will only send referral offers to individuals with whom they have an existing personal relationship, and will not engage in unsolicited marketing or spamming.

5. Commissions

5.1 Commission Structure:

Commissions are calculated as a percentage of the transaction value, currently 10 % of each eligible purchase made through a valid referal link, or a fixed monetary amount, as determined by Musa Gold.
All commissions earned by participants through the Referral Program shall be referred to as “ Musa Credits.” These Credits will be accrued in accordance with the terms and conditions of the program and may be redeemed or utilized solely in the manner prescribed by the Company.
Credits are non-transferable, have no cash value, and may not be exchanged or refunded except as explicitly authorized under the program rules. The accumulation and use of Credits are subject to the Company’s sole discretion and may be amended, suspended, or terminated at any time without prior notice
Commissions earned through the Program are subject to applicable taxes, and Partners are solely responsible for tracking and fulfilling all tax obligations relevant to their jurisdiction of tax residency..

5.2 Commission Payout:

Commissions will be reflected on the Partner’s account approximately 15 banking days after the new customer’s confirmed purchase and GRR generation, subject to verification, and payout regulations with regards to potential cooling period (section 7.1 below)
Commissions are only earned on eligible transactions that result in a completed order and GRR generation.
Transactions involving fraud, chargebacks, cancellations, or self-referrals are not eligible for commissions.

6. Coupons

Musa Gold may provide Partners with coupons to attract new customers.
Coupons offer discounts to end customers but do not affect commission calculations.
Partners are responsible for distributing coupons in compliance with these Terms and applicable laws, including only to individuals with whom they have an existing relationship.

7. Payouts

7.1 Eligibility:

Partners shall be entitled to receive a commission equivalent to ten percent (10%) of the net purchase value generated through successful referrals, which shall be credited to them in the form of “Musa Credits.” These Musa Credits may be accumulated and subsequently redeemed exclusively for the purchase of Musa Gold product packs, currently limited to either a single (1-pack) or ten-unit (10-pack) option.
Once the referring partner has accrued a sufficient balance of Musa Credits to match the value of either available purchase option, they may initiate a redemption in accordance with the prevailing terms of the program.
Musa Credits hold no monetary value, are non-transferable, and may only be utilized within the framework of the program as determined by the Company.
Payouts are payable when the cooling period of the Refered customers cooling period (2 weeks) has expired.
No monetary payouts are part of this referal program.

7.2 Payout Process:

If enabled, Partners may request payouts through the Partner Dashboard.
Upon requesting a payout, Partners must create an order on the Musa Gold website to facilitate the payout process.
Musa Gold will mark the order as completed, generate a GRR, and process the payout for the approved commission amount.

7.3 Taxes:

Partners are responsible for reporting and paying any applicable taxes on commissions earned.
Musa Gold may withhold taxes as required by law.

7.4 Forfeiture of Commissions:

If an Partner ceases to be a Partner in the Program (e.g., through termination or voluntary withdrawal) and has not converted their commissions into GRR purchase rebates within 2 weeks of cessation, all unpaid commissions will be forfeited.
The earned commissions are valid maximum six (6) month after the last sale through the Partners referall link.

8. Partner Responsibilities

8.1 Promotional Activities:

Partners must promote Musa Gold in a lawful, ethical, and professional manner, targeting only individuals with whom they have an existing personal relationship.
Promotional methods must be disclosed during registration (e.g., website, social media).
Partners must ensure that referred customers have consented to share their personal data with Musa Gold and receive Program-related marketing communications.

8.2 Prohibited Activities:

Engaging in self-referrals or attempting to earn commissions on personal purchases.
Sending referral offers to individuals without an existing relationship or without their consent.
Using Musa Gold’s brand, trademarks, or intellectual property without prior written approval.
Engaging in fraudulent activities, such as generating fake referrals or manipulating referral links.
Promoting Musa Gold on websites or platforms containing illegal, offensive, or inappropriate content.
Combining the Program with other offers, promotions, or discounts unless explicitly authorized by Musa Gold.

8.3 Compliance:

Partners must comply with all applicable laws, including those related to data protection (e.g., GDPR, CCPA), advertising, and taxation.
Partners are solely responsible for the content and methods used in their promotional activities.

9. Termination

9.1 By Musa Gold:

Musa Gold may terminate your participation in the Program at its sole discretion, with or without cause, including for:
- Violation of these Terms, including self-referral or unauthorized promotions.
- Fraudulent or unethical behavior.
- Unsatisfactory Partner rating or account history.
- Inactivity for 12 consecutive months, from the day the referal link is generated.
Upon termination, unpaid commissions may be forfeited, and access to the Partner Dashboard will be revoked.

9.2 By Partner:

Partner may withdraw from the Program at any time by notifying Musa Gold in writing.
Commissions not converted to GRR purchase rebates within 2 weeks of withdrawal will be forfeited.

10. Intellectual Property

Musa Gold grants Partners a limited, non-exclusive, revocable license to use the provided referral link and approved promotional materials solely for the purpose of the Program.
Partners may not modify, copy, or distribute Musa Gold’s intellectual property without prior written consent.

11. Limitation of Liability

Musa Gold is not liable for any indirect, incidental, or consequential damages arising from ~~your~~ Partner participation in the Program.
Musa Gold does not guarantee the performance of the referral link, Partner Dashboard, or the Program’s availability.

12. Indemnification

In addition to the warranty in Section 4.2, you agree to indemnify and hold Musa Gold harmless from any claims, losses, or damages arising from your participation in the Program, including violations of these Terms, applicable laws, or third-party rights (e.g., data protection violations).

13. Governing Law and Dispute Resolution

In the event of a dispute, the decision of Musa Gold shall be final and binding.

This Agreement shall be governed by and construed in accordance with the laws of the United Arab Emirates.
Any dispute, controversy, or claim arising out of or in connection with this Agreement shall be finally settled under DIFC-LCIA Arbitration Center Rules, seat in Dubai, UAE, in English, with one arbitrator.

15. Additional Features

Musa Gold may enable or disable additional features as described in the SliceWP Features documentation.
Any enabled features will be communicated to Partners and governed by these Terms.
